1. About these terms

These Terms of Use apply to your use of this website. By using the website you agree to them. If you do not agree, please do not use the website.

In these terms, “ForenSys”, “we”, “us” and “our” mean ForenSys Consulting Pty Ltd (ABN 18 653 342 628), trading as ForenSys. “You” means any person who accesses or uses the website.

2. Information on this website

The content on this website, including service descriptions, Insights and case studies, is general information about ForenSys and the fields we work in. It is not forensic, legal, technical or other professional advice, and it does not take your circumstances into account.

Do not act on anything on this website without first obtaining advice that is specific to your matter. We take care to keep the content accurate and current, but we do not warrant that it is complete, accurate or up to date at any given time.

3. Case studies and Insights

Case studies are published with the permission of the clients involved. Insights describe general observations drawn from our work. Examples are generalised so that no client, case or engagement can be identified, and they should not be read as a description of how any particular matter was or will be handled.

4. Enquiries do not create an engagement

Contacting us through the website, by email or by phone does not create a client relationship, and it does not oblige us to act for you. An engagement begins only when we have both agreed its scope and terms in writing.

Please do not send confidential information, evidence or details of a live matter through the enquiry form. Tell us briefly what you need and we will arrange a secure way to receive anything sensitive.

5. Intellectual property

Unless stated otherwise, ForenSys owns or licenses the intellectual property in this website, including its text, graphics, logos, illustrations and code. Third-party names and logos, including client and partner logos, belong to their owners and appear with permission.

You may view the website and print or save pages for your own reference. You must not copy, reproduce, adapt, publish or commercially use any part of it without our prior written consent, except as permitted by the Copyright Act 1968 (Cth).

6. Acceptable use

You must use the website lawfully. In particular, you must not:

  • attempt to gain unauthorised access to the website, its server or any connected system;
  • introduce malicious code, or interfere with the website’s operation or security;
  • use automated tools to scrape or harvest content or personal information from the website; or
  • submit false, misleading or offensive information through the enquiry form.

7. Links to other websites

The website links to websites operated by third parties, such as our technology partners. We provide these links for convenience. We do not control those websites and are not responsible for their content, availability or privacy practices.

8. Liability

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law, ForenSys is not liable for any loss or damage, including indirect or consequential loss, arising from your use of the website or your reliance on its content. Where our liability cannot be excluded but can be limited, it is limited to supplying the relevant service again or paying the cost of having it supplied again.

9. Availability

We aim to keep the website available, but we do not guarantee uninterrupted or error-free access. We may change, suspend or remove any part of the website at any time without notice.

10. Privacy

Our Privacy Policy explains how we collect, use and protect personal information, including information you send us through the website.

11. Changes to these terms

We may update these terms from time to time. The current version is always published on this page, with its effective date. Your continued use of the website after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Australian Capital Territory, Australia. You submit to the non-exclusive jurisdiction of the courts of that Territory and the courts that hear appeals from them.
